PLEASE TAKE NOTICE, that a public hearing will be held by the Board of Trustees of the Incorporated Village of Lake Grove, at the Village Meeting Hall, 980 Hawkins Avenue, Lake Grove, New York on Thursday the 17th day of November 2022 at 6:00 p.m. to consider the following:

LOCAL LAW NO. OF THE YEAR 2022
AMENDING SECTION 159-32 OF THE LAKE GROVE VILLAGE CODE
EXTENDING A MORATORIUM ON SUBDIVISON
APPLICATIONS AND APPROVALS THAT WOULD CREATE SUBSTANDARD, UNDERSIZED OR NONCONFORMING LOTS
BE IT ENACTED BY THE BOARD OF TRUSTEES OF THE
INCORPORATED VILLAGE OF LAKE GROVE AS FOLLOWS:
Section 1.0 Enactment, Effective Date,

2.0 General Provisions.
2.1 Amendment of Section 159-32 of the Lake Grove Village Code
3.0 Severability.
1.1 Title.
This Local Law shall be entitled Local Law of 2022 Amending Section 159-32
of the Lake Grove Village Code to extend the Moratorium on Subdivision Applications
and Approvals that would Create Substandard, Undersized or Nonconforming Lots.
1.2. Enactment.
Pursuant to Section 10 of the Home Rule Law and the Village Law of the
State of New York, the Incorporated Village of Lake Grove, County of Suffolk and
State of New York, hereby enacts by this Local Law of 2022, a Local Law of the
Village of Lake Grove.
1.3. Effective Date.
This Local Law shall take effect on the filing of the approved Local Law with
the Secretary of State of New York, which shall be within twenty (20) days after its
approval by the Board of Trustees of the Incorporated Village of Lake Grove.
1.4 Purpose and Intent of Local Law.
- The Board of Trustees of the Village of Lake Grove hereby finds that
the subdivision of property in the Village of Lake Grove that would create
substandard, undersized or nonconforming lots has the potential for negative
impacts on the environment, the aesthetics and quality of life in the Village of Lake
Grove, and the Board of Trustees has determined that it is in the best interests of the
Village of Lake Grove that there be established a one year moratorium on
subdivision applications and approvals for subdivisions that would create
substandard, undersized or nonconforming lots in the Village of Lake Grove.
- The intent of this local law is to prevent any further impacts on the
environmental or quality of life that may be potentially caused by subdivisions in
the Village of Lake Grove while the Village of Lake Grove is studying the potential for
impacts from future subdivisions that would create substandard, undersized and
nonconforming lots and development of the subdivided lots in the Village of Lake
Grove.
2.0 General Provisions.
2.1 Section 159-32 of the Lake Grove Village Code is hereby amended to read
as follows:
- 159-32 Moratorium on Applications and Approvals of Subdivisions that would
Create a Substandard, Undersized or Nonconforming Lot.
- 159-32(1) Moratorium in effect.
There shall be a moratorium in effect on all subdivision applications and
approvals of subdivision applications which would create a substandard, undersized
or nonconforming lot in the Village of Lake Grove.
- 159-32(2) Period of moratorium.
The moratorium shall continue in effect for a period of one year from the date of
the filing of this local law with the New York State Secretary of State unless ended
earlier or extended by the Board of Trustees by amendment of this Section 159-32.
- 159-32(3) Applications and approvals during moratorium period.
The Village of Lake Grove, its officers, employees, and boards shall not accept,
process or approve any application for subdivision that would create a substandard,
undersized or nonconforming lot during the moratorium period, and the processing of any
such application that may be pending is hereby stayed during the moratorium period.
- 159-32(4) Extension, modification or termination of moratorium period.
The moratorium period may be extended, modified or terminated by the Board of
Trustees of the Village of Lake Grove by the adoption of a local law.
- 159-32(5) Study during moratorium period.
The Village of Lake Grove shall work towards conducting a study on the
negative impacts and effects of subdivision of property creating substandard, undersized
or nonconforming lots and the corresponding construction or development during the
period of the moratorium.
- 159-32(6) Severability.
In the event that any section or portion of this Section shall be deemed to be
unenforceable or of no effect, the remainder of the chapter shall survive and remain in
full force and effect.
3.0 Severability
3.1. In the event that any provision of this Local Law should be deemed or
determined to be invalid or unenforceable for any reason, then the remaining sections of
this Local Law shall continue in full force and effect.
