WHEREAS, notice of public hearing was duly given and said hearing was duly held at the Village Meeting Hall, 980 Hawkins Avenue, Lake Grove, New York on the 21^st day of December 2023 at 6:00 o’clock in the afternoon on a local law as follows:

LOCAL LAW #9-2023

A Local Law # 9-2023 Amending Chapter 38-1 Review of purchase type; competitive bidding; documentation, and 38-3 Method of purchase, Provisions of the Code of the Village of Lake Grove as follows:

• 38-1-Review of purchase type; competitive bidding; documentation

1. Every purchase to be made must be initially reviewed to determine whether it is a purchase contract or a public works contract. Once that determination is made, a good faith effort will be made to determine whether it is known or can reasonably be expected that the aggregate amount to be spent on the item of supply or service is not subject to competitive bidding, taking into account past purchases and the aggregate amount to be spent in a year.  The following items are not subject to competitive bidding pursuant to § 103 of the General Municipal Law; purchase contracts under [$10,000] $20,000 and public works contracts under [$20,000] $35,000; emergency purchases; certain municipal hospital purchases, goods purchased from agencies for the blind or severely handicapped; goods purchased from correctional institutions; purchases under state and county contracts; and surplus and secondhand purchases from another governmental entity.

• 38-3- Method of purchase

1. The following method of purchase will be used when required by this policy in order to achieve the highest savings:

Estimated Amount of  Purchase Contract Method

$1 to $5,000 – At the discretion of the Mayor/Deputy Mayor or in his absence the Village Clerk.

$5,000.01 to $19,999.99 – 2 written/fax/email quotations will be sufficient, 3 recommended. A Village approved purchase order is required.

Estimated Amount of Public Works Contract      Method 

$1 to $10,000 – At the discretion of the Mayor/Deputy Mayor or in his absence the Village Clerk. A Village  approved purchase order is required.

$10,000.01 to $34,999.99 – 2 written/fax/email quotations will be sufficient, 3 recommended. A Village approved purchase order is required.
